I think I may rightly suggest to this inquiry that
we have already get quite a long way along the read. Your Worship was kind enough to intimate to me that I need net argus upon the
question of criminal conspiracy. You were satisfion that it was
there. The Jury were kind enough te intimate that it was net
necessary to cross-examine on the point that those people knew
that they were breaking the law. I therefore beg te suggest that
we have already arrived at a stage of fact that there was an
unlawful assembly. The peint left open to me now is te antisfy
this inquiry that not only was this an unlawful assembly, but that
it became a risteus assembly, and furthermore, that the sheeting,
such as was done,was done to prevent violent crime. Those appear
to me to be the two main headings new before us. There is ne
doubt according to the authorities that where there is an unlawful
assembly force can be used to disperse it, and it remains for the
Jury to say whether the feros was reasonable or unreasonable.

I think the first question the Jury should take into consideration
on this inquiry is the condition of the Colony and the general
situation at the time. In dealing with this I think the Jury should
particularly direct attention,net se much to the assembly when it
started.net so much to the assembly on the read,but to the state
of the assembly immediately before the firing took place because it
is in respect of the firing we are here to-day. The conditions in
